CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL: By ordering electronically through the website you are currently using, you are deemed to have accepted the pre-notification form and the distance sales contract offered to you. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other applicable laws in force regarding the sale and delivery of the purchased product. Shipping costs, which are the shipment cost, will be paid by the buyers. Each purchased product will be delivered to the person and/or organization at the address specified by the buyer within 30 days, provided that it does not exceed the legal period. If the product is not delivered within this period, the buyers may terminate the contract. The purchased product must be delivered complete and in accordance with the specifications specified in the order, along with any warranty certificate, user manual, and other documents if any. In case the sale of the purchased product becomes impossible, the seller must inform the buyer in writing within 3 days from the date he/she learns about this situation. The total amount must be refunded to the buyer within 14 days. IF THE PURCHASED PRODUCT IS NOT PAID FOR: If the buyer does not pay the purchase price or cancels it in the bank records, the seller’s obligation to deliver the product ends. SHOPPING MADE WITH UNAUTHORIZED USE OF CREDIT CARD: After the product is delivered, if it is determined that the credit card used by the buyer for payment has been unjustly used by unauthorized persons and the selling product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days at the expense of the seller. IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE SPECIFIED PERIOD DUE TO UNFORESEEN REASONS: If unforeseen circumstances arise that the seller cannot foresee and the product cannot be delivered within the specified period, the situation is notified to the buyer. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if the payment is made in cash, the amount is refunded to him/her in cash within 14 days from the cancellation. If the payment is made by credit card and is canceled, the product price is refunded to the bank within 14 days from the cancellation, however, it may take 2-3 weeks for the bank to transfer it to the buyer’s account. THE OBLIGATION OF THE BUYER TO INSPECT THE PRODUCT: The buyer will inspect the goods/services subject to the contract before receiving them; he/she will not accept damaged or defective goods/services from the cargo company. The received goods/services will be deemed to be undamaged and sound. After the delivery, the buyer is obliged to protect the goods/services with care. If the right of withdrawal will be used, the goods/services must not be used. The invoice must be returned with the product. RIGHT OF WITHDRAWAL: The buyer may exercise the right of withdrawal from the contract by rejecting the product without any legal or criminal liability, provided that he/she notifies the seller within 14 (fourteen) days from the delivery date of the purchased product to himself/herself or to the person/organization at the address specified by him/her. DURATION OF RIGHT OF WITHDRAWAL: If the product purchased is a service, this 14-day period starts from the date the contract was signed. In service contracts where the service has started with the consumer’s approval before the expiration of the withdrawal period, the right of withdrawal cannot be exercised. The expenses arising from the use of the right of withdrawal shall be borne by the SELLER. For the right of withdrawal to be exercised, it is necessary to notify the SELLER in writing by registered mail, fax, or e-mail within 14 (fourteen) days and the product must not have been used within the scope of the “Products for which the Right of Withdrawal Cannot be Used” stipulated in this contract. USE OF THE RIGHT OF WITHDRAWAL: The invoice of the product delivered to the 3rd person or to the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution. In cases where the returns with invoices issued on behalf of companies are not possible without an invoice, the return transactions will not be completed.) Return form, the box of the products to be returned, packaging, if any, standard accessories must be delivered complete and undamaged. RETURN CONDITIONS: The SELLER is obliged to return the total price and the documents that put the BUYER under debt to the BUYER within 10 days at the latest from the date the withdrawal notification reaches him/her and to take back the product within 20 days. If there is a decrease in the value of the goods due to the fault of the BUYER or if it becomes impossible to return the goods, the BUYER is obliged to compensate for the damages of the SELLER in proportion to his/her fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the product or service within the right of withdrawal period. If the campaign limit amount set by the SELLER is exceeded due to the use of the right of withdrawal, the amount of the discount benefited within the scope of the campaign is canceled. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED: Goods that are prepared according to the buyer’s request or explicitly personalized, that cannot be returned, underwear bottoms, swimsuits, makeup materials, disposable products, goods that are in danger of deterioration or have a possibility of exceeding the expiry date, goods that are not suitable for return due to health and hygiene after they are delivered to the BUYER and the packaging is opened, goods that are mixed with other products after delivery and cannot be separated due to their nature, except for those provided within the scope of the subscription agreement, goods related to periodicals such as newspapers and magazines, electronic goods that are instantly performed in electronic environment or instantly delivered to the consumer, audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer supplies, the return of which has not been opened by the BUYER. In addition, the use of the right of withdrawal for services that are started to be performed with the approval of the consumer before the expiry of the withdrawal period is not possible according to the Regulation.
